Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of aptus.in (the "Site"), operated by Aptus ("Aptus", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Use of the Site
The Site is provided to give visitors information about Aptus's services — cloud and infrastructure management, network operations, data analytics, and compliance advisory — and to enable prospective clients to get in touch with us. You agree to use the Site only for lawful purposes and agree not to:
- Attempt to gain unauthorized access to the Site, its underlying systems, or related networks;
- Interfere with or disrupt the Site's operation, including via automated scraping that places undue load on our infrastructure;
- Submit false, misleading, or malicious content through any form on the Site; or
- Use the Site in any way that violates applicable law.
3. Intellectual Property
All content on the Site — including text, graphics, logos, the Aptus name and marks, and the underlying design and code — is owned by Aptus or its licensors and is protected by applicable intellectual property laws. Client and partner logos displayed on the Site (for example, in the "Customers We Work & Have Worked With" section) remain the property of their respective owners and are used to identify past or present business relationships. No content on the Site may be reproduced, distributed, or used to create derivative works without our prior written consent, except as permitted by law.
4. Services & Engagements
Descriptions of services on the Site (Build, Operate, Understand, Secure, Trust) are provided for informational purposes and do not, by themselves, constitute an offer capable of acceptance or a binding commitment to deliver services. Any engagement for Aptus's services — including scope, pricing, service levels, and data processing terms — is governed exclusively by a separate signed agreement (such as a Master Services Agreement, Statement of Work, or Data Processing Agreement) between Aptus and the client. In the event of any conflict between these Terms and a signed client agreement, the signed agreement controls for that engagement.
5. Forms & Communications
When you submit a form on the Site (for example, the "Talk to Us" contact form or the DPDP self-assessment), you represent that the information you provide is accurate and that you have the right to provide it. Submitting a form does not create a client relationship or any contractual obligation on Aptus's part; it initiates a conversation which may lead to a separate engagement. 6. Third-Party Links & Services
The Site may link to third-party websites or services we do not control, including our DPDP self-assessment platform at dpdp.aptus.in and our LinkedIn page. We are not responsible for the content, policies, or practices of third-party sites. Your use of any third-party site is governed by that site's own terms and privacy policy.
7. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Statistics, credentials, and figures referenced on the Site (such as years of experience or certification status) are accurate to the best of our knowledge as of the date of publication and are subject to change.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Aptus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of, or inability to use, the Site, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms affects the terms of any separate signed client agreement.
9. Indemnification
You agree to indemnify and hold Aptus harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms.
10. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
11. Changes to These Terms
We may revise these Terms from time to time. The "Effective date" at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
